We are OmarcoTV (“We”, “Us”, “Our” or “OmarcoTV”) a registered company in Jordan with a  national ID 200054154 and its registered address is in Amman, Jordan. These Terms and Conditions  (“T&Cs”) apply to the use of all platforms provided by OmarcoTV including applications developed  and/or published by OmarcoTV, OmarcoTV’s webpages and other online channels (“Platform”). These T&Cs govern the relationship between platform user (“You”) and OmarcoTV regarding the usage of,  and the accessibility to, our Platform. You agree to these T&Cs and agree to be bound by them by downloading, installing, browsing the Platform or using any part of which. 

The use of our Platform is outright governed by OmarcoTV’s Privacy Policy. These T&Cs along with OmarcoTV’s Privacy Policy streamline your legal rights and obligations. If you do not agree to these T&Cs, please send an email with your perspective to legal@omarcotv.com before you use of the Platform.

Unless otherwise the context indicates, and for the purposes of the interpretation of this T&Cs, the following terms shall read as follows: 

“You” and “Your” shall refer to any visitor, user or person who accesses to, or uses the Platform in any manner whatsoever.  

“We”, “Us”, “Our” and “OmarcoTV” refer to Hanan Abdin and Partners Co.. and/or any of its online Platform(s) and/or affiliates as the case may be.  

“Platform” shall refer to any platform(s), web pages(s), applications owned by or operated by OmarcoTV unless otherwise indicated. 

“Personal Data” means personally identifiable information that specifically identifies You as an individual.  

“Content(s)” shall refer to any or all information, products, services, items, materials, promotional programs, pictures, images, videos, featured articles, texts, adds, messages, numbers and all components relevant to the subject matter of these T&Cs in whatever format or type, whether such Content is  provided by You, other users, third party, and/or OmarcoTV. ​ 

By using, visiting and accessing our Platform You agree that You have read, understood and agree to be bound by these T&Cs. And Your continued use of our Platform now or following any changes to the T&Cs indicate your acceptance of these T&Cs and any changes thereafter. If You do not wish to be bound by these T&Cs, You are kindly requested to immediately refrain from using Our Platform or please send an email with your perspective to legal@omarcotv.com before you use of the Platform. In addition, by accessing, using Our Platform, You agree to fully comply with all the T&Cs stipulated herein in conjunction with the applicable laws and regulations of the Hashemite Kingdom of Jordan. 

These T&Cs constitute a contract between You and OmarcoTV, and apply to all users of this Platform. Any person or entity using this Platform is compliant to OmarcoTV’s T&Cs.

Although we provide rules for user conduct, We do not control or direct third-party actions and We are not responsible for the contents or information any third-party may transmit or share (such as advertisements). By using OmarcoTV, You acknowledge and agree that You may be exposed to Content that is inaccurate, misleading or otherwise objectionable beyond Our control or knowledge. You are responsible for and must evaluate all risks associated with, the use of any Content. You should not rely on said content and under NO circumstances will OmarcoTV be liable or responsible in any way for any loss or damage of any kind incurred as a result of using, browsing or reading any Content listed, emailed or otherwise made available on the index pages of our Platform, and We are not responsible of the completeness of any transaction related to our Platform. 

You agree that We may, at any time, unilaterally modify and amend these T&Cs at Our sole discretion and as We find it necessary. You hereby agree in advance to abide by and be fully bound by such modified and amended terms even if they are in conflict with these T&Cs or subject you to additional obligations. You are solely responsible for reviewing   these T&Cs from time to time as the T&Cs may be automatically updated, changed or modified by Omarco TV at any time and at its discretion. All revisions and amendments to these T&Cs shall be effective immediately upon posting them thereafter and OmarcoTV will not be responsible to inform You or notify you of such amendments, therefore, You must review the T&Cs on a regular basis. Your continued access and use of the Platform will be considered as unconditional acceptance of the amended terms. If You do not agree to be automatically bound to any amendments to these T&Cs or to any of the current terms or policies attached or referred to these T&Cs, You may cease and stop using the Platform immediately pursuant to the termination and cancelation terms thereunder. 

In consideration with the provision of third-party ads, all content(s), materials on the Platform including without limitations, the Platform, texts, software, scripts, graphics,   photos, sounds, music, videos, interactive features, trademarks, logos contained therein, are the sole property of OmarcoTV or its affiliated companies, licensed by OmarcoTV or used with permission by OmarcoTV and is protected by the applicable laws. Nothing herein, shall be construed to grant you any rights in relation to such content and in no event, must be used, copied, reproduced, transmitted, sold, licensed, or otherwise exploited without obtaining a prior written consent of OmarcoTV. 

You acknowledge and agree that OmarcoTV does not permit, authorise or condone and hereby expressly prohibits user from accessing or using the Platform in a manner that infringes, or is likely to infringe, the intellectual property rights (all industrial, commercial and intellectual property rights - including equivalent, neighbouring or proximate rights anywhere in the world that currently exist or are recognised in the future), or the security of the hosting server or any other rights or privileges of any person anywhere in the world.

You acknowledge and agree that OmarcoTV has the right, at its sole discretion, to modify and amend the Content and the Platform features from time to time without notifying You. 

OmarcoTV is not responsible in any way of any third party’s content available at its Platform.

The Platform and all the Content available thereunder is the sole and exclusive property of OmarcoTV, notably including the Platform content, namely text, logos, images, and other distinctive signs. You hereby undertake not to harm, directly or indirectly via the intermediary of a third party, the intellectual property rights of OmarcoTV over the Platform. You hereby refrain from reproducing any element of the Platform, republish, sell, rent, sub-license, duplicate, copy or redistribute any content from the Platform, by any means whatsoever, in any form whatsoever and on any medium whatsoever, without the prior consent of OmarcoTV.

The Platform is accessible online 24/7, aside for in any case of force majeure, any event outside the control of OmarcoTV and/or the Platform host, and any breakdowns or maintenance required for proper operation of the Platform, which will not lead to any compensation. OmarcoTV expressly reserves the right, without compensation, to amend the Platform in whole or in part at any time as well as its presentation or medium and to interrupt update of the Platform without notice. The liability of OmarcoTV may under no circumstances be incurred for any direct, indirect, incidental, special or consequential damages whatsoever suffered by yourself or any third party, resulting directly or indirectly from access and use of the Platform or inability to access and use the Platform. In all instances, the liability of OmarcoTV, in such instance as it is incurred, will be limited to the direct prejudice suffered with the exclusion of any indirect prejudice, of any nature whatsoever, such as notably loss of data, loss of opportunities, of profits or operation, or any other financial loss resulting from use or impossibility to use the Platform. 

The legal responsibilities and liability of OmarcoTV are either limited or excluded; as you take on risk, full responsibility of using the Platform provided. You acknowledge and agree to defend, indemnify, and hold OmarcoTV, its officers, subsidiaries, affiliates, successors, directors and employees harmless from and against any and all claims, damages, obligations, losses liabilities, costs, debt or expenses (including legal fees) arising out from, in connection with or related to: 

a.  Any violation of any of these T&Cs.  

b.  Any violation of any applicable laws and regulations in the Hashemite Kingdom of   

      Jordan and/or in jurisdiction which the Content is posted or received or You are a 

      residence of. 

c.  Any violation of any Third-Party IP rights, including without limitations any copyright, 

     trademark, or trade secret. 

d.  Any claim related to any damage, loss, loss of business or otherwise, that your Content, 

     way of use and actions may have caused to OmarcoTV, user or any Third-Party. And as 

     far as the law allows, this indemnification obligation shall survive termination of these 

     T&Cs. 

e.  In all cases, you agree that OmarcoTV shall not be liable for any damages of any kind 

     resulting from any aspect of your use of OmarcoTV Platform.

You acknowledge and accept to use OmarcoTV, its Platform and or any other users’ content or any Third-Party is entirely at your own risk without any express and implied warranties of any kind, including without limitations, inaccuracies of content, false or   misleading content, errors, viruses, mistakes, damages or loss of any nature, liability, performance, security, unauthorized access, Third-Party liability. 

By using OmarcoTV and its Platform, You acknowledge and agree that certain features of the Platform may require You to download content, software and/or agree to additional terms and conditions. In addition, You acknowledge and agree that we may make any inquiries that We consider necessary, either​ directly or through third parties, concerning your identity and We are entitled to save all such information for our records and You also authorize OmarcoTV to provide your general information to third party.

We respect Your privacy and have developed a detailed Privacy Policy incorporated into these T&Cs, that govern the information obtained from users which You also agree on them and you acknowledge that the Privacy Policy constitute an integral part of the T&Cs.  

You acknowledge and agree that OmarcoTV provides the Platform, Applications on an "as is" and "as available" basis. Nothing in these T&Cs shall or may be construed as a representation or warranty by OmarcoTV that the functionality or operation of the Platform and/or the Application will meet your requirements, be uninterrupted or free of errors and inaccuracies, or operate in the configuration or with the hardware or software used by You.

These T&Cs shall be governed by and construed in accordance with the applicable laws of the Hashemite Kingdom of Jordan. Any dispute, controversy or claim arising out of, or relating to or in connection with interpretation, implementation and enforcement of these Terms and Conditions shall be referred to the sole jurisdiction of the Palace of Justice of Amman.

A. You are subject to all laws of the geography in which you open the Platform and are solely responsible for obeying those laws. OmarcoTV cannot be held liable if laws applicable to you restrict or prohibit your participation. OmarcoTV makes no representations or warranties, implicit or explicit, as to your legal right to access or participate in the Platform nor shall any person affiliated, or claiming affiliation, with OmarcoTV have authority to make any such representations or warranties. OmarcoTV reserves the right to monitor the location from which you access the Platform and to block access from any jurisdiction in which participation is illegal or restricted. 

B. If any part of the OmarcoTV’s T&Cs is found illegal or unenforceable, in whole or in part by any court of competent jurisdiction, such provision shall, as to such jurisdiction, be ineffective solely to the extent of such determination of invalidity or unenforceability without affecting the validity or enforceability thereof in any other manner or jurisdiction and without affecting the remaining provisions of OmarcoTV’s T&Cs, which shall continue to be in full force and effect.
